Anti-child abuse campaigners are demanding that rock star Pete Townshend be treated as a sex offender when he plays at next year's Superbowl concert in America. They want the guitarist of The Who to provide DNA samples and fingerprints and to pose for a police mug shot before being allowed to perform during the half-time show of America's biggest sporting event. The Protect Our Children group had called for Townshend to be stopped from entering the country because of his 2003 child porn arrest. [...] Florida state law says anyone with a sex offender background must register with police and provide fingerprints, DNA samples and a mugshot.

After spending nine years on the FBI's most wanted list, a New Hampshire man pleaded guilty to sexually assaulting a 5-year-old boy in Deerfield, N.H. Police said Jon Schillaci ['Dylan Thomas' on Boy Chat] fled when the investigation into the assault started and was on the run until they caught up with him in June 2008. Schillaci was arrested in Mexico after spending nearly a decade on the run. Schillaci was sentenced to 20 to 50 years in prison after pleading guilty to one count of felonious sexual assault and 23 counts of possession of child pornography. The investigation began October 1999 when a 5-year-old told his parents that Schillaci had improperly touched him.

[T]hey did not experience the abuse as awful when it happened because most simply did not understand clearly the meaning or significance of the sexual behaviors they were engaging in. The abuse is intentional on the part of perpetrators. Someone the child knew violated social norms. I cannot offer a clear theoretical model as to exactly how and why sexual abuse damages victims. It is beyond the scope of my research.
The less traumatic sexual abuse was when it happened, the more betrayal, guilt, isolation, and shame victims will feel and the more psychological distress and dysfunction victims they may experience in the aftermath. [... T]he trauma model is not just failing to help victims; it is actually causing some of the harm it was supposed explain [...]. [It is not causing some of the harm but almost all of it and that is exactly what the abuse industry wants to achieve.]
[Susan A. Clancy writes many times that pedosexual contacts (she calls it always abuse) in most cases leads to intense harm, but she doesn't give data supporting this claim in her book. 'Her' victims were responding on ads in newspapers where she looked for 'sexual abuse victims', so only people who feel victimized will be likely to respond...]

[Eve Kosofsky] Sedgwick's essay - part imperative, part elegy, as her title indicates - reports on a historical shift barely noticed despite its momentousness. In 1973, with fanfare, the American Psychiatric Association decided to drop from the next edition of its Diagnostic and Statistical Manual (the DSM-III) the diagnostic category ''homosexuality,'' thus removing it as a pathology. By its next appearance in 1980, the DSM, sleight-of-hand fashion, had added an entry: ''Gender Identity Disorder of Childhood,'' which, Sedgwick tells us, ''appears to have attracted no outside attention ... nor even to have been perceived as part of the same conceptual shift.'' In essence, the DSM freed the homosexual only to embattle the child. It waged war against homosexuality precisely on a field where a war could be hidden: the protogay child. [...]
And these suspicions were underscored a while ago (in September, 2006) by the ''Foley scandal,'' involving Congressman Mark Foley (R-Florida), who was mentoring congressional pages aged sixteen. When he ''harmed'' these ''children'' by talking with them about sexual pleasure, his and theirs, it became more evident what ''harm'' is, according to the public: anybody's pleasure, an adult's or the child's, that comes to children (even to their ears) before it is time.
Harm is any form of premature ejaculation (a ''sudden ... utterance,'' says the dictionary) involving children.

Thousands of women appear to be using the internet to share sexual fantasies of abuse involving children. An investigation by The Independent on Sunday found a series of websites that depict female-perpetrated child abuse as ''natural, educational and enjoyable'' for children. [...] An excerpt from one website reads: ''If you are a female child lover we want you to know there is nothing wrong with you. The biggest problem is the teachers, therapists, cops, clerics and parents who force their stale morality on the young people in their custody. For children, experiencing sexual pleasure is not damaging at all, they enjoy it ... just like we do.''

A third of pupils have been taken out of school after a raft of alleged sexual incidents. There have been 18 recorded cases at the Queensland school since last year with 11 incidents reported to police. Both males and females were the alleged offenders and experts said the children could be copying each other's behaviour.

In the next several months, the Supreme Court will decide at least a half-dozen cases about the rights of people accused of crimes involving drugs, sex and corruption. Civil liberties groups and associations of defense lawyers have lined up on the side of the accused. But so have conservative, libertarian and business groups. The rush to try more and more children as adults began in the 1980s when the country was gripped by hysteria about an adolescent crime wave that never materialized. Joe Sullivan, the petitioner in Sullivan v. Florida, was sentenced to life without parole in 1989 - when he was just 13 - after a questionable sexual battery conviction. His two older accomplices testified against the younger, mentally impaired boy. They received short sentences, one of them as a juvenile.

If we are looking only at attraction to pubescent and pre-pubescent individuals, research suggests that between 25 and 30% of men are attracted to children in these age categories to an extent that is at least equal to the attraction they feel for sexually mature individuals. (See, for example, Godeon, C, Hall, N, Hirshsman, R and Oliver, L., ''Sexual Arousal and Arousability to Pedophilic Stimuli in a Community Sample of Normal Men.'' Behavior Therapy, 1995, 26). That is a very large number of people. But society now defines ''children'' as people up the age of eighteen - which obviously includes a very large number of sexually mature individuals. The number of men who are attracted to these older ''children'' is much larger. It seems reasonable to surmise that virtually all males who are not exclusively child-oriented feel attracted to people who are socially defined as ''children'' but who are sexually mature. Hormones, after all, are not controlled by social definitions and norms. So depending on how we define ''children'' and thus understand who is a ''pedophile'' we find that anywhere from 25% to almost 100% of men fall into this category. That's an awful lot of people to demonize.

NAMBLA is often falsely portrayed in the media as an organization of ''child molesters'' in part because we have consistently and adamantly opposed age-of-consent laws. Of course, the media never seems to follow up with any questions about why we oppose them. We see age-of-consent laws operating in our society in much the same way as burquas function in fundamentalist Islamic societies - ostensibly to protect a group but ultimately to oppress it. We reject the notion that sexual love is so horrible that (in our case) men and boys must be kept firmly apart by the most dire methods.

Polish MPs have passed legislation making it obligatory to chemically castrate certain sex offenders. Under the law anyone found guilty of raping children under 15, or close relatives, will be given drugs to lower their sex drive. All but three MPs present in the lower house voted for the measures. They were part of a bill that also increases jail terms for incest and paedophilia, and criminalises any attempt to justify paedophilia. Anyone propagating such a view is subject to a prison term of up to two years.

Davidson draws our attention to the variety of social conventions surrounding male same-sex relationships, even within the geographically small area of ancient Greece. The very idea of ''Greek love'' or ''Greek homosexuality'' as a single social institution comes to seem somewhat misguided as Davidson shows how very differently people behaved in, say, Sparta, Elis, and Athens. The Athenians - who have bequeathed us the most evidence - were very unusual; citizens of other Greek cities were puzzled by the Athenian practices of ''paederasty,'' or ''boy-love,'' which involved the courtship of young men but which were also associated with the boys' education. Davidson emphasizes that we should not think of these relationships in terms of child abuse. He argues, more vigorously than other historians have done, that the Athenians themselves were very much concerned to mark the distinction between those who were underage (i.e., under 18) and those who were not. As Davidson portrays it, same-sex relationships - which seem to have generally taken place between youths in their late teens and young men in their early 20s - were an important part of a boy's journey to manhood.

In 2003, 17 year-old honor-student and homecoming king Genarlow Wilson was caught having consensual oral sex with his girlfriend, who had not yet turned 16. He was convicted of aggravated child molestation, sentenced to a minimum of ten years in a Georgia prison, and forced to register as a sex offender for life. If Wilson and his girlfriend had just had good old-fashioned intercourse, as opposed to oral sex, their ''crime'' would have been a misdemeanor, punishable by a maximum of a year in prison and no sex offender status.

A 19-year-old Courtenay man has been sentenced to seven years in prison for killing a man he believed had raped a 13-year-old girl. Clifford Frederick Martin pleaded guilty to manslaughter last week in connection with the death of Cory Headen, also 19, who was beaten with a baseball bat as he lay sleeping in his bed in September 2008.

In this Note, I will argue that the Sentencing Commission should amend the guidelines for possession of child pornography because, (1) the guidelines are the result of 'morality earmarks' rather than the product of empirical or academic study; (2) the empirical evidence calls into question the asserted link between possession of child pornography and future sexual assaults of children; and (3) by failing to consider the nature of internet downloading, most of the 'enhancements' are actually part of the core offense of possession. Several federal district courts have cited these and other deficiencies in their decisions to sentence defendants below applicable guideline ranges. Though the Supreme Court's recent decisions in Rita and Kimbrough permit trial courts to disregard sentencing guidelines that lack empirical basis, most courts still rely heavily on the guidelines to impose lengthy sentences. Accordingly, I propose that the Sentencing Commission amend section 2G2.2 in a manner that reflects the tenuous connection between possession and contact offenses, and in light of the realities of Internet use.

In our new bizarre world of sexual offender legislation each child is a victim and a perpetrator. As the victim, they get no help, of course. The victim status is the excuse needed so that the sledgehammer may be used on the other child. So each becomes a perpetrator. They will be arrested; they will be forced into court. They are likely to be convicted and sentenced. They may be placed into the various prisons for children that have been established-places where they will learn what unwilling, sexual attacks are really like. They will be tortured by therapists and eventually released-maybe. Even that is no longer guaranteed under our sex panic. Today, someone who has served their sentence can then be held in preventative detention for the rest of their natural life because the mob demands it. And the politicians give the mob what it wants. If our children happen to be released then the real torture begins. hey are branded by the cruel laws that opportunistic politicians imposed to satisfy fearful voters. First, the child will be photographed. His or her photo will be published for the world to see, much like the poor boy above. The government hit lists, called sex offender registries, will tell any would-be vigilante where to find this child. The address will be given, if the child is lucky enough to be able to live at home, and not institutionalized. [...] Each time the child moves the police will help him feel welcomed by handing out fliers to the neighbors warning them that a ''sex offender'' is now living nearby. Rocks thrown through windows can be mild compared to some welcomes that are given. One young man in Maine, opened his door to be executed on the spot, by a stranger. His crime was that he, as a teen, had sex with his girlfriend. In puritanical America that is enough to make him a sex offender. For that he was murdered with his mother only a few feet away. In jurisdiction after jurisdiction this ''offender'' will find that most of the community is zoned off limits to him. He can't live too close to a school, too close to a park, too close to a bus stop, too close to..., the list is almost endless and growing all the time. [...] These kids are criminals, not necessarily because they violated the life, liberty or property of another person. They are criminals because the politicians defined them as criminals. These damned ''family values'' conservatives, and compassionate feminist Leftists, who banded together to ''save the children,'' turned America's kids into sex offenders by fiat. And they feel good about it. They are satisfied by it and only wish more had been rounded up earlier. An academic who studied paedophiles has described how she was castigated by hostile colleagues but encouraged by other academics who found her research ''excitingly naughty''. Sarah Goode, senior lecturer in health and community studies at the University of Winchester, concludes that there is no clear consensus among academics on the harmfulness of adult sexual contact with children. [...] Colleagues also expressed ''concerns'' about the ethics of her research. She said that some of these doubts were ''a covert expression of 'tabloidophobia' - a horror that the more aggressively anti-intellectual tabloid newspapers could come knocking and embarrass everyone''. [...] In 2004, Richard Yuill, a doctoral student at the University of Glasgow, was accused of ''playing into the hands'' of paedophiles because his thesis described positive sexual experiences between children and adults. Glasgow decided not to publish it. David Evans, social sciences lecturer in the same Glasgow department, whose research interests include all aspects of human sexuality, said that many aspects of his work ''remain taboo in whole or part to social scientists''. ''There are as many positive retrospective accounts by adults of their same-sex pre-'age of consent' sexual experiences as negative,'' he said. ''It is encumbent upon sociologists to report on, analyse and seek to explain these accounts. However, the 'panic' responses within and outside the discipline largely silence and trivialise this work.''

First, paedophiles exist. This is a scary thought and something many people find difficult to accept. [...] Adults sexually attracted to children probably form something like 2 per cent of the adult male population and no doubt form a relatively high percentage of those who choose to work in settings with children and young people. They may well not be exclusively sexually attracted to children; they may form relationships with women, join families, form new families, and parent children. Without getting hysterical about these facts, we need to soberly asses them. How should we respond to this?
My second main conclusion is that policy, media and charity approaches which demonise paedophiles make the situation worse. It may be a good strategy for getting votes, selling newspapers and raising funds to send out messages about 'stranger danger' and portray paedophiles as evil monsters lurking round every corner, but it is not a good strategy for protecting children effectively, which surely should be our most immediate priority. [...] Both practitioners and policy-makers need to pursue methods of child protection which are sensitive, which do not make assumptions, and which focus primarily on what people
do without being blinded by who they
are. [...]
My third main conclusion is that current criminal-justice interventions do not work. If they did, we would not still have rates of child sexual abuse running at epidemic proportions (Itzin 2006). Criminal justice interventions are a blunt tool. If the only option available is to 'grass' on a perpetrator (who may also be a family member or friend) then many people prefer simply to ignore the abuse and thereby also avoid the shame and embarrassment of the public process of a trial. This means that children are not protected. It also means that, if the only response is punitive, adults who are concerned about their own or a loved one's sexual attraction cannot get help and support.

Authorities allege Carlstrom and other inmates stomped and tortured Chamberlain - whom they believed was a child molester. Chamberlain was awaiting trial on misdemeanor charges of possessing child pornography. [...] ''My life has been destroyed,'' Carlstrom wrote. He also alleged inmates must adhere to a culture of ''discipline by violence,'' including obeying jail guards when they order them to beat other inmates.

Most people think the sex offender registries were only recently established. However, the registry of today is the direct descendant of a program that started in the 1930s. Originally intended to keep Mafia gangsters from setting up shop in Los Angeles, it later became a tool for harassing homosexuals in the McCarthy era. [...] In the meantime, the country was also experiencing growing anxiety about another kind of crime: sex. A tug-of-war was building between social liberals who viewed consensual sexual activity as a private matter that was no business of the law and moralists who believed that growing sexual license was ruining the society. Military and police operatives began using subterfuge to entrap homosexuals in lewd acts. Consensual homosexual activity between adults was a felony, with long prison terms often followed, in many states, by indefinite civil commitment that could keep the ''pervert'' locked up for the rest of his life. In 1938, the Los Angeles Police Department established its Bureau of Sex Offenses. The bureau began keeping careful records, with fingerprints and photographs, of sex offenders, and operated a clinic for performing psychiatric evaluations of people arrested on sex charges.

Darren Kawamoto, a registered sex offender who threatened six journalists in front of rolling cameras last November, has been sentenced to a minimum term of 36 years in prison. The 45-year-old man originally faced 25 years to life for each of the six people he threatened. Media crews from Sacramento, including a reporter and photographer from FOX40 News, were attempting to gather a reaction from Kawamoto following a community meeting in which residents expressed concern about a registered sex offender moving in to their area.

Edmund White's quasi-autobiographical novel of 1982 [A Boy's Own Story London: Picador (1983)] virtually opens (page 14) with a scene of 'underage' sex between two boys - one fifteen, the other twelve. What is extraordinary, scandalous even, about this scene is not merely that it quite obviously isn't a 'one-off' experiment - the boys are at it every night for the remainder of the younger boy's stay (he is the son of the fifteen-year old's father's business acquaintance who, with his wife and two boys, has been invited for a short vacation). It isn't even that the older boy is having anal intercourse with a younger boy: this scenario can be (and just about everywhere else, is) rendered as a depiction of sexual abuse. Our culture presently insists that this is the only form in which sexual activity between minors can be represented - a bigger older person, invariably male, using his superior strength to sexually dominate a smaller, younger person. It is rather that the abuse narrative is conspicuously and joyously absent from the boys' sexual encounters with each other: the sex is initiated by the younger boy. It is a scene of simple, innocent sexual enjoyment, mutual pleasure-sharing, in which the boys make no demands on one another other than to experiment with reciprocally thrilling penile fun together. They do not become lovers, they do not enter a long-term monogamous relationship, and they do not renounce or denounce their sexual experiments later in life in favour of compulsory chastity and abstinence for the young. Against the grain of our culture's symptomatically coercive scripting, they are not subsequently destroyed as adults as a result of their 'under-age' sex. They do not self-harm, develop eating disorders, or become alcoholics. Clearly, this is not meant to happen. In other words, these boys cannot be truthfully represented in mainstream narratives of love and morality. Their innocent intimacy can only be represented as a sexual crime; if they were to be discovered during their libidinal explorations, even more so now in our age of near-psychotic sexual paranoia about children, one or both of them would be placed on the Sex Offenders Register and forced to undergo compulsory 'treatment programmes', which are indistinguishable in fact from the psychological bullying and vulgar brainwashing that dissidents from Stalinist ideology were subjected to in the Soviet Union. It would come as little surprise to find one, at least, of them yielding to the overwhelming institutional pressure they would inevitably be subject to (couched, of course, in terms of adult 'concern' to 'protect' children); quite possibly, the younger of the two, despite actually being the initiator, would feel impelled to adopt the abuse narrative being offered to him as his only escape route, and impugn the older boy.
White's novel is enlightening largely because, insofar as 'abuse' features at all, it appears in the form of pre-emptively disgusted and narrow-minded adults, from horrified parents to deeply worried mental health professionals, rigorously suppressing non-normative expressions of erotic pleasure in the young. In Normotopia, the world of sexual normalcy, deviance is a disease contracted from an external source (invariably, a pervert/paedophile). But in Freud's intelligent analysis of the sexual status quo, normality itself is a tyrannising regime aimed at coercing a universal, originary pleasure-seeking, innocent and experimental, into the straight-jacketed, joyless world of conventional moralism. [...]
True scientists, at least ideally, seek intelligent, informed efforts to disprove their discoveries; only then, when such efforts fail, can the provisional label 'truth' be applied. Ideally in science, truth is never above contestation and even revolution; it is, or ought to be, a radically democratic and reasoned project. But fascists - ideological and moral fascists, fascists with a small 'f', not merely jackbooted neo-Hitlerites (as Foucault, I think, would concur) - seek only agreement with preconceived credos and received wisdom, no matter how injurious and murderous these belief systems turn out to be in practise. It is perhaps superfluous to add that these two perspectives - true, open scientific enquiry and fascism (with a small 'f') - constitute radically irreconcilable perspectives. [...] The British psychoanalyst, Christopher Bollas, once wrote an intriguing essay called 'The Fascist State of Mind', which directly addresses the small 'f' fascism in us all. Bollas believes that this 'little f' fascist, the parts of ourselves which hold that (social/racial/sexual) purity and innocence is always being threatened by diseased or perverted outsiders (Jews, blacks, immigrants, paedophiles, in chronological order), can be recruited by charismatic demagogues in times of social dislocation to make mass fascism, the kind that carries a capital 'F', not only possible but inevitable.

This June, District Attorney David Capeless of Berkshire County, Massachusetts announced that he was dropping all charges against 44-year-old Bernard Baran, a man who has spent half his life behind bars on child molestation charges that the state no longer has the confidence to retry. Baran was convicted in January 1985 of molesting six children at a pre-Kindergarten daycare facility in Pittsfield, Massachusetts. He was released on bond in 2006 after an appeals court determined that his trial attorney had been incompetent and that the prosecution may have withheld key exculpatory evidence. Baran says that during his jail term he was raped and beaten more than 30 times, necessitating six different transfers to new correctional institutions. Such is the cost the prison system exacts on an openly gay man convicted of molesting children. Baran was one of the first people in the country to be prosecuted in the daycare sex abuse panic of the 1980s, a bizarre, nationwide hysteria fed by fears of satanism, homophobia, and a wing of child psychology that used unproven interrogation techniques critics say caused children to recount sexual incidents that never took place.

The Nobel laureate Sir William Golding, whose novel Lord of the Flies turned notions of childhood innocence on their head, admitted in private papers that he had tried to rape a 15-year-old girl during his teenage years, it emerged today. Golding's papers also described how he had experimented, while a teacher at a public school, with setting boys against one another in the manner of Lord of the Flies, which tells the story of young air crash survivors on a desert island during a nuclear war. The revelations will appear in a forthcoming biography of the writer, who died in 1993 at the age of 81.

Take one newly pervasive communications medium that makes some people apprehensive. Add concern about sexual exploitation of children that makes everyone apprehensive. Stir in a few highly publicized cases of pedophiles luring innocent young kids to horrible fates via email or Facebook. Season with echoes of Hansel and Gretel. And what comes out of the oven? Full-blown hysteria that every child with an Internet connection faces substantial risk from sexual predators. The hysteria may be real. But the actual threat is negligible. Last year, the attorneys general of 49 states created the Internet Safety Technical Task Force to investigate sexual solicitation of children by molesters who troll for targets using sites popular with kids, among them, MySpace and Facebook. The 278-page report concluded that there's no real problem.

This article addresses four central questions. First, what is the difference between normal law enforcement policy and a 'war' on crime? Second, assuming such a line can be discerned, has the enactment of the Adam Walsh Child Protection and Safety Act ('AWA') in combination with other sex offender laws triggered a transition to a criminal war on sex offenders? Third, if such a criminal war is emerging, what will be the likely effects of such a transition? Fourth, if such a criminal war is emerging with substantial negative consequences, can it be stopped? By reviewing America's history of criminal wars, primarily in the War on Drugs, the article identifies three essential characteristics of a criminal war: marshaling of resources, myth creation, and exception making. It concludes that the federalization of sex offender policy brought about by the AWA elevated law enforcement to a nascent criminal war on sex crimes. This change could have repercussions as substantial as the drug war has had on American criminal justice and society.

All parents want to protect their children from sexual predators, so politicians can nearly always win votes by promising curbs on them. Those who object can be called soft on child-molesters, a label most politicians would rather avoid. This creates a ratchet effect. Every lawmaker who wants to sound tough on sex offenders has to propose a law tougher than the one enacted by the last politician who wanted to sound tough on sex offenders.

It's a kind of Stalinism that promotes the fear of bogeymen, doubts our worth as parents and demands we must prove ourselves to the state before enjoying the simple - and, yes, innocent - delight of a contact with a child who is not our own. A moment should occur in every child's life, when he or she meets an adult from outside the family and that adult takes an interest in them as a person and shows the child that they have something to offer. This is an important part of becoming a successful individual and I imagine most people reading this remember with pleasure - retrospective awe, in my case - when someone outside school and the family valued them for what they were. Now these contacts are to be policed with a formal structure of suspicion that implies to the child that every adult who has not been checked is a potential abuser. Philip Pullman last week said of the new law, which he likened to Clause 28: ''It seems to be fuelled by the same combination of prurience, sexual fear and cold political calculation.''

Men without a prior sex conviction who look at child pornography on the internet are unlikely to sexually assault a child, according to Swiss scientists. Researchers led by Frank Urbaniok of the Canton of Zurich Department of Justice delved into the criminal record of 231 men who were charged with viewing child pornography via a US website. In the six years before the 2002 police operation, only one per cent were known to have committed a hands-on sex offence. And only one per cent of the men committed a hands-on sex offence in the six years afterwards. The study reinforces previous research which found most consumers of internet child pornography are well-educated and view other types of illegal pornography as well, including sexual acts involving animals or violence.

Codey Hawks, 19, was sentenced today to 28 years in prison for raping [that is having sex with] a 12-year-old Parma boy. Cuyahoga County Common Pleas Judge Brendan Sheehan also deemed Hawks, of Burton, Mich., a sexual offender who will have to register his home and work addresses with a sheriff's office every 90 days for life. Hawks had sex with the boy in January 2008, when he visited the child's Parma home after meeting him on the Internet playing Xbox Live, Assistant Prosecutor Jesse Canonico said. Hawks traveled to Ohio Jan. 23 and spent three nights at the house. He performed sexual acts on him several times. Hawks pleaded guilty to rape, importuning and gross sexual imposition.

Only a river separates a small Polish border town from Germany. The local teenagers, are wide-eyed at their neighbours' standard of living. Tomek is a good student, he's interested in astronomy and plays football to please his father. Except that he lives in a little border town plagued by unemployment and poverty, whereas, on the other side of the river, lies Germany with all its relative affluence. When Tomek meets Marta at his first disco and falls in love with her, he starts to think up ways of earning money in order to keep her interested. After attempts to make some cash smuggling dogs, he approaches the pimp Borys who finds local boys for his German clients. Tomek has no idea of the brutal fate which awaits him. The filmmaker regards the emotional cynicism and cruelty of teenagers as a phenomenon fuelled by the destructive force of desperate poverty. Not only does it destroy family relationships and Christian values, but criminal behaviour is also no longer perceived as a sin.

I [artist called Bernard] was persecuted back in South Africa almost all of my young life and spent quite some jail-time for being in possession of pornography - my own work, that is. The last time I was arrested I would have had to spend about four years in prison since I had become a repeat offender, which is one of the reasons why I escaped and came to live in Holland. I was assured that I would not be prosecuted for my art here. [...] I showed my artworks - those that I had salvaged from the South African authorities as most of my work there was destroyed - to two prominent art experts from both the Stedelijk Museum and the Rietveld Academy here in Amsterdam. They both assured me that my work would not be considered offensive to the Dutch law lords, since art was protected by the constitution and the laws on freedom of speech. A teenager who has profound mental disabilities was sentenced to 100 years in prison after pleading guilty to charges in a sex abuse case involving his 6-year-old neighbor. Aaron Hart, 18, of Paris, was arrested and charged after a neighbor found him fondling her stepson in September. The teen pleaded guilty to five counts, including aggravated sexual assault and indecency by contact, and a jury decided his punishment. Lamar County Judge Eric Clifford decided to stack the sentences against Hart after jurors settled on two five-year terms and three 30-year terms, The Dallas Morning News reported Wednesday. The judge said neither he nor jurors liked the idea of prison for Hart but they felt there was no other option. [...] Hart has an IQ of 47 and was diagnosed as mentally disabled as a child. He never learned to read or write and speaks unsteadily. [...] ''He couldn't understand the seriousness of what he did,'' said his father, Robert Hart. ''I never dreamed they would think about sending him to prison. When they said 100 years - it was terror, pure terror, to me.''

As the historians Steven Schlossman and Stephanie Wallach showed in an influential 1978 article, the age of consent was raised and vigorously enforced in early 20th century America not out of any concern with adolescent male sexuality so much as with the control of ''precocious'' female sexuality, which threatened to escape the bonds of patriarchal control due to rapid industrialization and urbanization. The age of consent was as low as 10 or 12 in the mostly rural society of early 19th century America. Although clad in the rhetoric of public health and social hygiene, the move to raise the age of consent was closely connected to the racist preoccupations of the eugenics movement, as well as to concerns about mass immigration, miscegenation, and ''public morals.'' Sexually active women and girls were identified as socially dangerous ''deviants needing permanent care and, if possible, sterilization.'' The focal concern was control of young female bodies: when the patriarchal family could no longer retain its control, the state stepped in to control female sexuality by the force of law. The intent of the age of consent laws was not to protect children from predatory adults, but to keep young women's desires under control; at the same time that the law denied adolescents the ability to ''consent'' to sexual contact, it did allow them to marry at a younger age if their parents consented, or not infrequently, coerced. Contemporary feminists should not support the strengthening and extension of laws that were in their origin designed as tools of state paternalism and patriarchal control over young, female, working-class, ethnic bodies. In the Progressive Era, the age of consent technically applied to underage males as well, but was seldom enforced or used to control sexually active boys.

If the anti-onanism discourse converted autoeroticism into one of the most contemptible and destructive acts for the individual and the community, then that of CSA has converted every experience of erotic significance between a minor and an adult into one of the worst things that could happen to a child and one of the vilest acts that could be committed by an adult. The adult in these experiences became the universal symbol of evil and villainy, and the abuse victim was installed as the epitome of human suffering. The premise of universal trauma is the scientific expression of CSA dogma, which is promulgated in the tragic rhetoric of pain and devastation, and in which the minors involved are often equated with survivors of horrible experiences, such as concentration camps (Herman, 1992; Ullmann & Hilweg, 2000). After more than two centuries of preeminence, the masturbatory harm hypothesis was definitively abandoned in the middle of the twentieth century by social scientists who in its place introduced a condescending view in which autoeroticism became an innocuous and even positive experience in a person's development. It was concluded that harm could only come from socially induced stigma and not from the practice itself (Hare, 1962; Money, 1985b; Neuman, 1975). [...] Jenkins (1998, 2003) has pointed out the existence of cycles throughout the twentieth century in which CSA generated successive waves of anxiety between periods of relative indifference and/or moderation. Other twentieth century authors have described child/adult sexual experiences as unimportant and as being made problematic only by societal reaction (Bender & Blau, 1937; Constantine, 1981; Kinsey, Pomeroy, Martin, & Gebhard, 1953; Schultz, 1973; Ullerstam, 1964). The current social hysteria began to take hold around 1970 and has continued and grown until the present, although there may be some signs that the CSA hypothesis is beginning to lose strength: There are cases of persons who develop normally in spite of having suffered sexual abuse. Because of that, we should adopt a perspective in accordance with this reality which would allow us to encourage survivors. Therefore, we must remember that we are all vulnerable to the ''clinical fallacy''...and that our point of view is biased by our professional experience, which leads us to pay greater attention to those who do not get better than to those who do and recuperate. (Finkelhor, 1999, p. 206) Nevertheless, as the above quotation suggests, most continue to be fixated on the CSA hypothesis of harm. These experiences almost invariably are considered to be intrinsically traumatic, and only can be dealt with properly by disregarding and suppressing any conflicting testimony from the minor, by assuming maximum harm, and by involving both law enforcement and professional intervention (Berliner & Conte, 1993, 1995; Browne, 1996; Finkelhor, 1984; Henry, 1997). Few social scientists pay any attention to the opposing non-harm hypothesis that might better explain any given incident, and the concept that negative social reaction might be the principal, if not sole, source of actual harm to the minor (Constantine, 1981; Goodyear-Smith, 1993; Kinsey et al., 1953; Schultz, 1973) is basically ignored by both academia and the media. The experience is defined as traumatic by nature and in terms of its near and long term effects, and unimportance is unimaginable, just as it was in years past with masturbation.

As a country, we have a very weird relationship with children. We have turned them into a depository for our better nature. All children are now considered innocence and perfection rolled into one. While we - adults and young adults (now known commonly as hoodies) - are the opposite: evil-minded and untrustworthy. Obviously, adults are all potentially dangerous. But we have started to consider them as if they are innately dangerous. For the record, children are usually not angels. They are, in fact, as cruel and manipulative as any adult. They're just cuter. Some modern psychology even sees them as far less moral than adults, their social brains having not been formed yet. [...] We have paid a high price. More than a quarter of England's primary schools now do not have a single male teacher, leaving 4,587 school staffrooms populated solely by women. People in the street are extra cautious even coming into contact with children, for fear of some mad accusation being made against them. [...] The UK now regularly appears at the bottom of Unicef tables for child well-being across industrialised countries. Paradoxically, we have made our children less safe.

Sex offenders are just like the rest of us, according to criminologist and researcher Philip Birch. Birch, who has come from the United Kingdom to take up a position at the University of New South Wales (UNSW), challenges the notion that sex offenders are psychologically damaged, lonely, insecure or dysfunctional. Instead, he says we are more likely to find offenders in our homes, workplaces and neighbourhoods than lurking behind a bush in a dirty trenchcoat. ''It serves us well to construct the sex offender as the 'other', (to believe) they're not like us, that there's something pathologically wrong with them,'' Birch says. [...] Birch, who recently delivered a seminar entitled The Making of a Sex Offender at UNSW, bases his conclusions on a study he conducted two years ago that later became the book Sex as Crime?, published in 2008. Over ten percent of young teenagers are having sex, according to a large study of adolescents in Texas. Researchers at the University of Texas surveyed over 1,200 teens on their sexual activity, asking whether they engaged in vaginal, oral or anal sex. By age 12 over 12 percent of students had engaged in vaginal sex, nearly eight percent had oral sex and seven percent had anal sex. A total of 1,279 seventh-grade students (57.3% female, 43.6% black, and 41.8% Hispanic), mean age 12.5 years from 10 middle schools in a large southeastern U.S. public school district completed a cross-sectional survey using audio computer-assisted self-interviews. One-third of those kids did not use a condom, and one-fourth had four or more partners.

A controversial documentary movie about the abusiveness of the Catholic boarding schools (of past days, today only few survive) was released in Vienna. The Austrian bestselling author Michael Kohlmeier, who in his childhood had attended such schools, was interviewed after the opening. There he dared to voice his view that the whole issue about child abuse had gone into a totally wrong direction by putting its concentration on sexual abuse and creating the awareness and general attitude and laws exclusively into this corner. And nowhere else is more misinterpretation happening, as in reality the underlying motive and motivation for a large segment of these ''crimes'' has its roots in love, need for affection, need for tenderness, all actually positive human values. While on the other side the real abuse, the physical and mental abuse, mistreatment, the threats, use of force and power, creating the atmosphere of fear, etc. etc., which are so much more common and prevalent, go free, unnoticed and unpunished, truly sadistic tendencies. Isn't it time to change the system, change the laws, and bring sanity back?

Many of the best scientists of the twentieth century were so because they tended to think outside normal patterns, to see from odd angles. And then there were ones like Alan Turing, a man whose work probably saved more lives in World War II than any other individual's, whose sexual proclivities so threatened society it hounded him into committing suicide. Dr Daniel Carleton Gajdusek [won the 1976 Nobel Prize in medicine] fell into that last category for his love of boys and his defense of that love. Paedophilia has been a controversial subject over the years. In the 1960s the phenomenon gradually came into the public domain, due in no small part to the lawyer and socialist senator Edward Brongersma (1911-1998). He became known for his publications on the liberalization of legislation on public morals, in which he advocated greater freedom for young people to enter into sexual relationships. The 1970s - which were characterized by tolerance and public debate - saw increasing interest in intimate relations between children and adults. This theme was also examined in scientific studies, reports, theses (among others by Theo Sandfort, Monica Pieterse, Edward Brongersma), debates and congresses. The Dutch Society for Sexual Reform (NVSH) even set up a National Paedophilia Working Group. In the following decades interest in and tolerance of the subject rapidly decreased. In the USA a veritable child-protection industry arose which - spurred by a strongly conservative, orthodox Christian lobby - capitalized on the feelings of the public. In Europe the Dutroux affair created a shock. The issue shifted more and more into the taboo zone, leading to what one can call 'social censorship'. Due in part to the strong influence of the media on public opinion, it now seems virtually impossible even to discuss the subject.

A coalition of graphic artists, publishers and MPs have condemned Government plans to introduce a new set of laws policing cartoons of children, arguing that the current broad wording of the legislation could lead to the banning of hundreds of mainstream comic books. This week Parliament will discuss a new Bill which will make it a criminal offence to possess cartoons depicting certain forms of child abuse.

A serial child porn downloader and flasher today won an appeal against his potentially life-long jail term after top judges decided he could not be classified as a dangerous criminal. Peter John Barber (56), from Westwood, Peterborough, was handed an indefinite jail term ''for public protection'' in November 2008 at Peterborough Crown Court, after admitting a series of offences involving the distribution, making and possession of in decent images of children. The sentence, almost identical to a life term, meant Barber would not be freed until the Parole Board was convinced he was no longer a serious danger to society. But top judges today overturned the open-ended sentence, replacing it with a conventional four-year jail term, of which he will have to serve half before he becomes eligible for automatic release.

A former Houston-area member of Bikers Against Child Abuse has been arrested for possessing child pornography, officials announced this morning. Attorney General Greg Abbott said David Wayne Garvey, 50, was indicted by a Chambers County grand jury on third-degree felony charges. Each charge is punishable by a maximum 10 years in prison. [...] A search warrant on Garvey's home in Beach City allegedly turned up 83 images of child pornography on a computer, a CD and in e-mails, officials said.

President Barack Obama has nominated David Ogden for Deputy Attorney General. It is another bad nomination that should not be confirmed. Ogden is a hero to the porn industry for good reason. His clients include a long line of porn companies such as Playboy, Penthouse and Adam & Eve. But in his long career defending the interests of pornographers, no case is more shocking or repugnant than a case in which David Ogden fought for the rights of a pedophile to receive a certain genre of child pornography.

After two years of fitful searching, Christopher Noles and his family finally found a modest three-bedroom house in rural Georgia. The bedrooms are cramped, the kitchen plumbing leaky. There isn't a neighbor in sight. But the lonely old house is a last refuge. Mr. Noles is one of nearly 16,000 sex offenders convicted in Georgia who, under state law, can't live or work within 1,000 feet of a church, school, day-care center, skating rink, park, swimming pool or any other place where children gather. Failing to register an address could mean 30 extra years in prison for a convicted sex offender.
The crime that placed Mr. Noles, now 31 years old, in Georgia's database of sex offenders was having sex in August 1996 with his girlfriend. He was then 17, while she was 14. Both said the sex was consensual, and they later wed.

A doctor makes an incision in a man's scrotal sac and, deftly wielding his scalpel, quickly removes both testicles. In the Czech Republic, that simple operation is the punishment for male sex offenders. But to the Council of Europe, the region's leading human-rights body, the procedure is ''invasive, irreversible and mutilating.'' In a report issued last week, the council called the punishment ''degrading'' and demanded it be scrapped immediately. Over the past decade, at least 94 prisoners have undergone the treatment in the Czech Republic, the only country in Europe that continues to surgically castrate sex offenders. [...] Despite many studies of the effectiveness of castration - both surgical and chemical - the results are inconclusive. Some surveys suggest castration can dramatically reduce recidivism. One 1989 survey in Germany of 104 voluntary castrates showed a 75% drop in sexual interest, libido, erection and ejaculation. But measuring such changes is notoriously difficult and often depends on the subjective self-reports of sex offenders. A 1989 Psychological Bulletin study concluded that ''the recidivism rate for treated offenders is not lower than that for untreated offenders; if anything, it tends to be higher.'' [...] In its report, the Council of Europe also criticized the fact that the Czechs often use the punishment on first-time, nonviolent offenders, like exhibitionists. Another issue: the Czech penal system effectively forces many prisoners into accepting the procedure out of fear they will be jailed for life if they do not, according to the council. [...] Civil rights groups say any kind of castration, even if reversible, could take society down the road to eugenics. A 1985 U.S. Supreme Court ruling said that involuntary surgical castration constituted cruel and unusual punishment.

It's a bit hard to know what to make of Frederick Rolfe (''Baron Corvo''). One of the principle biographies of him is entitled Corvo: Saint or Madman?; if saint was more his own estimate of himself, madman was more the estimate of his contemporaries. [...] They hail him as a pioneer in modern literature who broke through the conventions of the Victorian novel in intent and content, and remained unappreciated, critically and commercially, in his time. (In this his story would be parallel to that of Vincent Van Gogh - to whom, curiously, Rolfe is similar in other ways: both had a failed religious calling which became an artistic calling; both had a somewhat dubious sexuality; both responded to the call of Mediterranean lands.) If all else fails, there is the 'How many of the hundreds of authors who published during the Victorian and Edwardian period are still being read today?' argument. In other words, our enthusiasm makes him important.

You all know about ''Megan's Laws.'' [...] The laws are designed to protect the public by mandating that convicted sex offenders register with local police and that police agencies keep the public informed about the whereabouts of these offenders. But do the laws really protect the public? Despite their enormous popularity, little research has been conducted into whether they work. Now, a federally funded study of New Jersey's law has found the following dramatic effects:
* Effects on sex offender recidivism: NONE
* Effects on time to first re-arrest: NONE
* Effects on number of victims: NONE
* Effects on state budget: $3.9 million-plus (as of 2007)
[...] Other research has suggested that the laws may not only be ineffective at reducing sex offending, but they may paradoxically increase sex offenders' risk through the secondary effects of social stigmatization, loss of employment and housing, and even physical victimization, all of which increase stress and social isolation and make it harder for sex offenders to successfully reintegrate into society. Americans are standing in hours-long, Depression-style lines for a couple of free eggs at Denny's. Our schools cannot even afford pencils or electricity in the classrooms. Yet we are willing to pay millions for laws that only provide an illusion of safety. Something is wrong with this picture.

Most of the actual acts depicted by the young models in child pornography are legal. Although some of the older pictures have sullen, battered looking children who look like they have been drugged or coerced, that is rarely true of more current photos. Impressionistically, the largest number of pictures on pornographic sites involves clothed photographs of pretty or good-looking children. Often they are in bathing suits. These are tainted simply because of their presence on pornographic sites, but, although they often have an erotic tinge, the pictures would not be considered pornographic in other settings. The next largest number consists of nudes of diverse quality and degrees of eroticism. Some pictures of boys show erections. Videos are a media that demand movement and they often show sex play and horseplay among the youths (especially boys), but no real sex (except masturbation or attempted masturbation). Masturbation, usually alone but sometimes in groups, and oral sex are also occasionally shown in still images. Generally both boys and girls look cheerful and healthy, although obviously this could be an act. Still the smiles and playfulness are often in hundreds of photographs of the same models, and giggles are ubiquitous in the films. The attempt is to portray an innocent and joyful sexuality, whether or not that is what is experienced by the models and actors. The pictures are far less tawdry and hard core than adult porn and are more playful. Domination is not an important theme and very few images (probably less than 1%) involve adults. Except for the rare adult involvement, none of these acts are illegal or clearly harmful in themselves, although the photographing of them is illegal. [...] The ostensible reason for denying even the minimum right to possess non-commercially distributed child pornography is that the production of the pornography harms the children portrayed, but this article has attempted to demonstrate that the argument does not hold up to analysis. In addition to the lack of evidence that the models are hurt, there is not a proximate connection between the production of images and anonymous possession of pictures downloaded for free from the Internet. [...] Speech and images may be related to behavior, but a basic principle of our law is that speech and behavior are not the same. Sexual pariahs are especially enticing, and deviant groups like them serve an important function. They leave non-deviants with a feeling of moral rectitude and help to unite them by reinforcing their feelings of superiority and virtue. Additionally, when minority groups identify themselves with the moral stance of the majority, it helps make them legitimate. Thus, feminists, gays, lesbians, religious conservatives, politicians, and others can all prove their moral worth by attacking child pornography. The fear of child pornography is also used to justify attempts to bring the new information technologies under the control of regulators. Just as being against a lynchee unites the lynchers, allowing them to feel they are protectors of the moral order, so this issue unites a fragmented American community. As Sartre noted in his discussion of the anti-Semite, ''by valiantly struggling against the Other as Symbolic Offender, the Just Man validates himself as good.''

A former mental hospital psychologist who said he became interested in child pornography while treating sex offenders was sentenced Friday to seven years in prison. Joseph Belanger, 61, of Jamestown, pleaded guilty last year to charges of receiving and possessing materials involving the sexual exploitation of minors.

Sweden's legacy of lax attitudes toward pornography has come back to haunt the country's national library, which has been found to have large quantities of child pornography in its collection. A former porn shop employee has revealed that the library's archives contain thousands of pornographic magazines, including several titles featuring young children. [...] While it's widely known that a wave of liberal thinking about sex and pornography swept across Sweden in the 1960s, fewer people are aware that it led to the legalization of child pornography. The government at the time initiated a review of freedom of speech laws in 1965, looking closely at provisions governing the portrayal of children. In 1971, a new law was passed which made it legal to buy, sell, and possess child, animal, and violent pornography in Sweden. [...] According to the Swedish Association for Sexuality Education (RFSU), Swedish attitudes towards child pornography were extremely liberal at the time. Citing ''the child's right to sexuality'', the Swedish Federation for Lesbian, Gay, Bisexual and Transgender Rights (Riksförbundet för sexuellt likaberättigande - RFSL) launched a 'paedophile working group' to lobby for lighter sentences for sex crimes against minors and for a lower age of consent. RFSL's efforts paid off in 1976, when a government commission issued a proposal including both suggestions, as well as the decriminalization of incest. The bill never became law, however, and Sweden eventually recriminalized child pornography in 1980, and RFSL switched positions on the matter.

Our man Conor Creighton met up with two of the nastiest people in the world. They're paedophiles and they're proud. They really have no idea how disgusting they are. [...] [Interviewer, I:] What do you do for a living, Ricardo? R: I was a Streetmaker. [I:] Sweetmaker? Like sweets? R: No streets. Bricks. I made streets and then I was fired for being a paedophile. [I:] So your boss found out you were a paedophile, was this after you made the YouTube flick? R: My boss knew it half a year before I lost my job and it was no problem. But with his girlfriend it was a problem. She found out when I went on YouTube. I went to court and the judge said that I was illegally fired so technically I'm still working for my boss but he doesn't pay me. And I couldn't get welfare either because they said I was still employed. Once I get money I can go look for other work. [I:] Do you really think you'll get another job? R: No. [I:] Why on earth did you make the video? R: I wanted to be honest. I don't like secrets. [...] [I:] Boys and girls learn it's dangerous to have sex with older people because they're too young to make a judgement on the situation and physically they're too young for sex. M: I don't think you can do be too young. Everything you like, no matter what age you are, you don't stop liking as you get older. It's only indoctrination that makes people not like things or feel embarrassed by them. Like if a very young child is masturbated by a granddad, people only have problems with that when they are older because it's taboo. You never have people complaining because they were on their grandfather's lap or he hugged me. It's only when people make it a taboo. [...] [I:] On your website it says you want to reduce the age of consent to twelve. Why stop there, why not eight or six or four years of age? M: In the end we want to abolish the age of consent totally but that's only when sexual taboos have been abolished. At six years of age you think it's nice to be touched on the genitals but when you are older you think it's a bad thing and you feel it was wrong. Society has to change first. [I:] Do you think it will change? R: I don't think so. [I:] So your situation is pretty much hopeless? M: I have a different opinion. He is very sceptical, but I think it will change when people think about child sexuality as a positive thing. Right now they see it as a bad thing. When they see it as not damaging their life, then it will be possible. [I:] What benefits do you think a child can get from a sexual relationship with an adult? M: I think there are a lot. They learn not to be afraid of strangers. Most strangers aren't bad guys. The traffic is much more dangerous than the chance people will do something to you. People are now afraid to hug children, especially men. People only know their parents or children, not adults who are on an emotional level with them. They say that all paedophiles rape children but that's not the case. [...] [I:] Okay, I'm looking around your room here and I see lots of children's DVDs, toys, stuffed animals and a Millennium Falcon. Are you guys just big kids yourselves? R: Paedophiles are on the same level as children. That's why they are more capable of knowing what's going on with children.

The Internet may not be such a dangerous place for children after all. A task force created by 49 state attorneys general to look into the problem of sexual solicitation of children online has concluded that there really is not a significant problem. The findings ran counter to popular perceptions of online dangers as reinforced by depictions in the news media like NBC's ''To Catch a Predator'' series. One attorney general was quick to criticize the group's report. The panel, the Internet Safety Technical Task Force, was charged with examining the extent of the threats children face on social networks like MySpace and Facebook, amid widespread fears that adults were using these popular Web sites to deceive and prey on children. But the report concluded that the problem of bullying among children, both online and offline, poses a far more serious challenge than the sexual solicitation of minors by adults. [...] In the cases that do exist, the report said, teenagers are typically willing participants and are already at risk because of poor home environments, substance abuse or other problems.

A federal appeals panel has upheld the 20 year sentence of a lolicon found to have received illustrations of underage sex by email, saying that ''it is not a required that the minor depicted actually exists'', and so ruling art not to be universally protected free speech. The court also insisted that purely textual email containing incest related material was not constitutionally protected free speech, and so also upheld his conviction on these grounds. The man concerned (55), a resident of Richmond, Virginia, is serving a 20 year sentence after being convicted in 2005 of ''receiving 20 Japanese cartoons, called anime, illustrating young girls being forced to have sex with men'', which he rather unwisely received using a public computer at the Virginia Employment Commission.

Children as young as five are being booted out of school for sex offences, shocking new figures reveal. In a damning indictment of the way youngsters are being sexualised at an early age, official government stastistics show 20 five-year-olds were excluded in just one year for sexual misconduct. They were among 280 primary school children aged under 11 kicked out during 2007 for a range of serious sex offences.
